General terms and conditions (AGB) SoulFly Paragliding UG (limited liability)

1. Scope
These general terms and conditions (GTC) apply to all contracts between SoulFly Paragliding UG (haftungsbeschränkt) (hereinafter “SoulFly”) and its customers. The subject of the contract includes in particular training, tandem flights, trips and the sale of air sports equipment and accessories.
2. Contractual partners and company structure
SoulFly Paragliding UG (haftungsbeschränkt) is represented by shareholders Kilian Hallweger and Elisa Deutschmann.
3. Conclusion of contract
3.1 By booking or ordering, the customer makes a binding offer.
3.2 The contract is only concluded upon acceptance by SoulFly, which is confirmed in writing or by email.
3.3 Deviations from the order are considered a new offer and require express acceptance by the customer.
4. Cancellation policy
4.1 Consumers have the right to cancel this contract within fourteen days without giving reasons.
4.2 The cancellation period is fourteen days from the date of conclusion of the contract/booking.
4.3 In order to exercise the right of withdrawal, the customer must inform SoulFly (Seestrasse 36, 83349 Palling, e-mail: [your e-mail address]) of his decision to cancel the contract by means of a clear statement (e.g. letter, e-mail).
4.4 In the event of a cancellation, SoulFly will refund all payments made by the customer immediately and at the latest within fourteen days from receipt of the cancellation notice.
4.5 The right of withdrawal expires prematurely if the contract is fully fulfilled with the express consent of the customer before the cancellation period has expired, in particular in the case of individual training and services.
5. Prices and terms of payment
5.1 All prices include VAT, unless otherwise stated.
5.2 Payments are due no later than 28 days before the start of the service. For trips, a deposit of 20% is required within 7 days of receipt of the invoice.
5.3 If the customer defaults on payment, SoulFly can withdraw from the contract after a reminder and claim compensation.
6. Eligibility requirements
6.1 The customer assures that he is physically and mentally fit to participate.
6.2 Minors require a written declaration of consent from their legal guardians.
6.3 Instructions from SOULFLY staff are binding and must be followed strictly.
6.4 The participant undertakes to have valid liability insurance for air sports equipment (including paragliding).
6.5 When traveling abroad, the participant is responsible for valid licenses, insurance and travel documents.
7. equipment
7.1 The participant is responsible for the completeness, functionality and airworthiness of their equipment.
7.2 Participants without full safety equipment (e.g. helmet, emergency umbrella) or with unapproved equipment may be excluded from participation.
7.3 If rental equipment is provided by SoulFly, the user is liable for damage due to improper handling.
8. Changes in performance
SoulFly reserves the right to adjust services for important reasons (e.g. weather conditions, official requirements), provided that the overall performance is not significantly affected as a result.
9. Withdrawal and cancellation by the customer
9.1 Withdrawal is possible at any time before the start of the service.
9.2 The amount of the cancellation fees depends on the date of withdrawal and can amount to up to 90% of the price.
9.3 The customer can name a substitute participant, provided that he meets the participation requirements.
10. Rebookings
Rebookings are possible once up to 30 days before the start of the service, provided that SoulFly can offer an equivalent alternative date.
11. Withdrawal by SoulFly
SoulFly can withdraw from the contract up to 14 days before the start of the event if the minimum number of participants is not reached or for unforeseen reasons. Payments already made will be refunded.
12. Termination for good cause
In the event of serious violations of participation conditions, safety requirements or hazardous conduct, SoulFly may terminate the contract without notice. There will be no refund.
13. Force majeure/pandemics
If implementation is significantly hampered or impossible due to unforeseeable events (e.g. natural disasters, pandemics, political unrest), both parties may terminate the contract. In these cases, SoulFly will offer alternative dates whenever possible, but is only obliged to make repayments to the extent required by law.
14. Weather-related regulations
14.1 Failures due to unsuitable weather conditions can be made up for, provided that SoulFly can offer suitable alternative dates.
14.2 The event is carried out by experienced participants depending on the weather and at their own risk.
15. Behavior during group trips/trips abroad
15.1 The participant undertakes to arrive punctually at meeting points and not to disturb the group structure.
15.2 Participants who impair the process or security through their conduct may be excluded from further participation. Return travel costs are borne by the participant.
15.3 Compliance with entry, visa and health regulations is the sole responsibility of the participant.
16. liability
16.1 SoulFly is only liable in case of intent or gross negligence.
16.2 The participant flies at their own risk.
16.3 SoulFly assumes no liability for accidents while flying or damage to its own or someone else's equipment.
16.4 When using third-party services (e.g. mountain transfers, hotels, shuttles), SoulFly is not liable for their implementation.
17. Data protection
Personal data is processed in accordance with the GDPR. Further information can be found in the privacy policy on the website.
18. Photo and media use
18.1 Photos and videos taken during events may be used by SoulFly for advertising purposes on the website, social media and print media.
18.2 The customer can object to this use in writing at any time. Content that has already been published will — as far as technically possible — be removed.
18.3 Data will only be passed on to third parties if they act on behalf of SoulFly (e.g. media partners, advertising agencies).
18.4 SoulFly is not liable for unauthorized use by third parties.
19. Insurance
19.1 The participant is required to take out valid accident and repatriation insurance.
19.2 When traveling, it is highly recommended to take out travel cancellation costs and travel interruption insurance.
20. Other provisions
20.1 Amendments and additions to these terms and conditions must be made in writing.
20.2 Should any provision of these terms and conditions be ineffective, the effectiveness of the remaining terms and conditions remains unaffected.
20.3 German law applies. The place of jurisdiction is — to the extent permitted by law — the registered office of SoulFly in Palling.
20.4 The contract language is German. German law also applies to international customers.
